Being in the construction industry for many years the issue of wearing a harness is complex. I have seen many guys that are natural on the roof and if you put a harness on them they become awkward.

I have seen that the harness gets tied up around their feet and may cause a fall. That being said the rules are to wear a harness but it adds costs to the job to place the "cleats" for tie down. There is also a surrounding "tie" line that is supposed to be in place.

I myself do not like two story roofs and would only go up with a harness but I do get in the way of guys who do not wear a harness but it does only take one fall to have an accident.

I think OSHA has better things to do than write 60,000 fine to a small contractor on a residential job of a home. Warnings generally seek compliance.
