Developer withdraws appeal over permit denial

The developer of a controversial North Naples golf course community has backed off from appealing the denial of a federal wetlands destruction permit.

Mirasol would have up to 800 homes and 36 holes of golf on more than 1,700 acres at the northwest corner of Collier Boulevard and Immokalee Road.

The U.S. Army Corps of Engineers denied developer J.D. Nicewonder’s permit application in December. As environmentalists cheered the rare victory, the developer appealed the decision.

The applicant withdrew the appeal this week, said Army Corps spokesman Rob Holland in Atlanta.

A spokesman with the South Florida Water Management District confirmed that J.D. Nicewonder has filed a new permit with the state agency.

The first permit called for the construction of a massive ditch, which proponents called a flow-way, that would drain into the Cocohatchee Canal. In its denial, the Army Corps said the project would destroy too many wetlands and that there were less damaging alternatives, such as removing the flow-way.
