The Dumas boat anchoring hearing set to take place Tuesday could pack a little extra something from what was reported in the Eagle on Monday.
As reported Monday, the hearing could deal with nothing more than the city’s motion to change legal counsel. The information was gathered from e-mails from city attorney Alan Gabriel to city Public Information Coordinator Lisa Douglass.
However, those involved with the defense of Dave Dumas, the boater charged with violating Marco Island’s mooring ordinance in January, said the defense is preparing for a hearing to dismiss the case against Dumas.
“There’s no official direction on what it will be, of course,” Dumas said. “It’s entirely up to the judge what’s going to happen.”
However, he said, his lawyer is planning to bring in all of the witnesses for the defense.
Herman Diebler, a supporter of Dumas, said that defense attorney Donald Day intends to present a motion to dismiss at the hearing, which is scheduled for 9 a.m. Tuesday at the Collier County courthouse in Naples.
