David Diamond, 58, still being held after violating a no contact order

Marco Island Police have not named any suspects in the suspicious death of a 51-year-old island woman Sunday. They aren’t even sure if it was foul-play, a police spokesman said.

Judith Diamond, 730 Tigertail Court, was found dead in her pool Sunday evening. MIPD responded to a call to her residence around 9:12 p.m. Sunday, where they found the woman floating face down in the pool.

Capt. Thom Carr, a spokesman for the department, said an autopsy is being done to determine the cause of death.

According to police reports, three bottles of alcohol and a wine glass were found at the scene. Carr said alcohol could be a factor in the woman’s death.

There are currently no suspects and foul play is not suspected, even though the victim’s husband was arrested at the hospital.

Carr said David Diamond’s arrest was not related to his wife’s death.

According to Kristi Lester, a spokeswoman for the Collier County Sheriff’s Department, Diamond, 58, was arrested after law enforcement officials found he was in violation of a protection order that barred him from being near his wife. Diamond was at the couple’s home subsequent to his wife’s death, according to the report.

Lester said the no-contact order had been put in place March 15, one day after Diamond was charged with domestic-related battery, a first degree misdemeanor.

On Tuesday morning, Diamond was still in jail and a bond hearing had not yet been set, Lester said.

Carr said the death is still under investigation.
