Charges of stealing marine scrap metal and reselling it have been leveled against two Lee County men.
Alvin Davila, 34, of 9352 Mantanzas Road, Fort Myers, and Daryl Eugene Fischer, 34, of 2119 Snead Drive, Lehigh, face charges of burglary, grand theft and trafficking stolen property. Davila faces an additional count of illegally claiming ownership of the scrap metal, Lee County Sheriff’s Office arrest records show.
According to records, on Sept. 29, the owner of Superior Marine, 17540 Rockefeller Circle, found that someone entered the fenced area of the business and removed several boat motor chassis and scrap metals stolen. The estimated value of the metal was $1,500.
A friend of the owner came by the business after hours on Sept. 26 to do some welding work. The friend had one of his employees, Fischer and Fischer’s friend, Davila with him.
“Aside from Fischer and his friend asking numerous questions about the motor parts in the rear of the business, they worked hard and appeared harmless,” the owner said.
All of the men left about 10:30 p.m.
On Sept. 27, everyone returned to complete the welding job. The owner noticed several items moved around within the scrap trailer, but he didn’t report it then because he wanted to ask one of his employees about it. The employee said he didn’t move or remove any items.
On Oct. 2, the owner confronted Fischer “who stated directly to him he knew his friend was taking and scrapping the items.”
Investigators located the business where the metal was scrapped. Two transactions were located, one at 7:34 a.m. Sept. 27 for 550 pounds of cast aluminum for $546.14; the other at 7:48 a.m. Sept. 30 for 651 pounds for $399.21.
Fischer, who has a previous felony arrest in Lee County for burglary and grand theft, was arrested Nov. 13 and posted $7,500 in surety bond.
Davila was arrested Wednesday and remained jailed Thursday. He has a lengthy arrest record in Lee County dating to 1997, as far back as computerized records show. Those arrests include several felonies and misdemeanors: violation of protective orders, forgery, grand thefts, possession of not more than 20 grams of marijuana, battery, burglaries and failing to appear in court.
Davila was released from prison in January, computerized Department of Corrections records show.
