A runaway charged with having pornographic images of herself on her cell phone was additionally charged Wednesday with cruelty toward a child.
The 14-year-old girl of Fort Myers originally was charged with possession of photographs of sexual performance by a child. The additional charge accuses of promoting sexual performance by a child.
The new charge was added after an investigator spoke with a Federal Bureau of Investigation innocent images task force investigator.
According to Lee County Sheriff’s Office reports:
On Tuesday, a deputy saw the girl in the 5500 block of Eight Avenue in the Pine Manor area of Fort Myers and knew she was a runaway. He took her into protective custody without handcuffs and notified her parents. She had a cell phone and the deputy took it for safety reasons. She immediately asked for it back and when the deputy asked why, she said there were “dirty pictures on her phone.”
Because she’s a juvenile, the deputy believed the contents were contraband. She gave him permission to look at the photos. There were a total of 176 images about half of which were pornographic. Some showed her and a man engaged in oral sexual activities.
Florida law states, "in essence that any person who produces images that contain the sexual acts of a child under the age of (18) commits a second-degree felony."
