Man charged with DUI after found passed out in shopping center parking lot

A Fort Myers man who was slumped over inside his car in the parking lot outside of the Bealls store off Pine Ridge Road was arrested for driving under the influence, according to authorities.

Kirk A. Stein, 36, of the 9200 block of Pomelo Road, Fort Myers, was arrested by Collier deputies early Monday morning.

Deputies were dispatched to the shopping center parking lot at 2368 Pine Ridge Road in reference to a man slumped over behind the wheel of a white Dodge Stratus, with the door open and his left leg out side of the car. The deputy had to nudge Stein awake and saw that his pants were unzipped and his clothes were in disarray.

A cooler was inside the car containing beer, a Mike’s Hard Lemonade and an alcohol energy drink called Four Loko.

At the jail, Stein’s blood alcohol level was .217 after the first test but he appeared to be trying to play around with the test by sucking in air instead of blowing into it for additional tests. When asked if he wanted to do the test again, Stein stuck his left index finger in his mouth. The officer told him his actions would be taken as a refusal to comply with the blood alcohol test.
