A Naples man with two young children in his SUV was charged late Sunday with drunken driver after nearly hitting a marked Lee County Sheriff’s Office vehicle in Estero, according to arrest reports.
Juan Lopez-Bautista, 32, of the 4000 block of 20th Place, Naples, was charged with DUI, DUI with a child younger than 18 years in the car and driving without a valid license. His license had been suspended in 2003 in connection with a previous DUI arrest, according to a Sheriff’s Office report.
According to the report:
Just after 9 p.m. a lieutenant stooped the 2002 Chevrolet SUV near Quente Way and Three Oaks Parkway after it nearly hit him and drove up over a curb. Two children, both younger than 10, were inside. The report did not indicate their ages, sex or how they were related to Lopez-Bautista. It was not clear whether the children were released to a relative.
Lopez-Bautista told a deputy he had drank two or three beers. Due to a language barrier, deputies took him to jail where a Spanish speaking officer interpreted. Lopez-Bautista then took the field sobriety tests and failed.
His breath alcohol tests resulted in 0.141 and 0.138. In Florida a person is presumed too drunk to drive if he has a breath test of 0.08 or above.
