Deputies: Burglar confronted by resident, locks himself in bathroom

An Naples man is accused of locking himself in a bathroom early Wednesday after he was caught breaking into a condominium unit.

A resident in a unit at 4450 Botanical Place Circle said he was in bed around 3 a.m. when he saw a man later identified as John Phillip Kirby, 44, open the door. The man asked Kirby what he was doing, and Kirby told him, "You startled me," according to an arrest report.

A woman downstairs said she heard a commotion upstairs and approached Kirby in the bathroom, telling him to leave. When he refused, she called the Sheriff's Office and left the home, reports said.

Neither the man nor the woman at the home said they knew Kirby.

Deputies said they unleashed their K9 after Kirby ignored their commands for him to exit the bathroom. Kirby grabbed onto the dog and refused to let go, reports said.

Kirby, of the 1200 block of South Alhambra Circle, faces charges of burglary, resisting an officer without violence and harming a police animal.
