Appeals court favors couple who sued Bonita Bay Group

The U.S. Court of Appeals for the 11th District has affirmed a ruling in favor of Frederick and Judith Feldkamp who fought to get their golf membership deposit back from the Bonita Bay Group.

Nearly a year ago, the Feldkamps won their case in federal court in Fort Myers after a nearly two-year legal battle. That ruling was challenged by Bonita Bay Group.

The Feldkamps, former members of the Shadow Wood Country Club in Estero, sued the Bonita Springs-based developer in April 2009, seeking their money back, plus damages for themselves and other members who resigned from Bonita Bay's clubs and couldn't get their deposits back.

U.S. District Judge John Steele in Fort Myers awarded the couple $92,000, the cost of their membership, plus interest, but stopped there. The appeals court affirmed Steele's ruling, saying there was no error in the summary judgement that awarded the couple their full damages.
