A transient who was shot by a Collier County sheriff's deputy last month was released from the hospital and arrested on Wednesday.
Duane Alan Gregory, 49, was booked into the Lee County jail on two out-of-county warrants. NBC-2 reports that Gregory is being charged with two counts of assault — one for each deputy involved in the Oct. 19 shooting.
Around 9 a.m. that day, Gregory held a gun to his head outside the 7-Eleven at Estey Avenue and Airport Road. Sheriff's Office Corporals Charles Creamer, 43, and Daniel Fano, 38, were called to the scene.
When Gregory refused their requests to lower the gun from his head, the deputies shot him, according to a witness. Although the gun appeared to be "realistic," it wasn't a real gun, the Sheriff's Office reported. Gregory was transported after the shooting to Lee Memorial Hospital in Fort Myers.
It is unclear when he will make his first appearance in Collier court.
