In the public comment section of the meeting, Regina and Tim Dayton went to the podium to make statements.
“Had our petitions been heard, none of these actions would have been necessary,” said Regina Dayton. “We have been portrayed as litigious malcontents. Wrongdoing by city officials has never been acknowledged.”
“The city is intent on proceeding with both actions. The meter keeps running. The law entitles us to legal fees,” said Tim Dayton. “Please pay our legal fees.”
“If the people of this community really understood, they’d have a much different opinion of us,” said Regina. “If we didn’t believe we were right, we wouldn’t have done what we did.”
“We had either incomplete or improper inspections. When the transcripts are heard, there will be very different assessments,” said Tim Dayton.

In order to “have a much different opinion” of the Dayton’s, I searched various Public Records.

This site shows the number of times a Notice of Commencement was issued, which indicates there must have been issues involved in the plans that were submitted by the Dayton’s, for their “Custom Built Home”, designed by an Architect, I assume they hired, and whose name never appears in any documents.

I also have many questions, which I hope the Dayton’s can answer, as to why they received so many mortgages from SunTrust under these circumstances, especially in 2009, , and also why, if the Dayton’s in 12/2008, were claiming to be filing bankruptcy, and then in 2013, found the cash to pay off a $350K mortgage.

Next, I reviewed the lawsuit filed by Dayton filed in 2009:

According to the lawsuit, Dayton’s claim the home does not comply with the Building Codes, and in Paragraph’s 31 and 32 they claim the Hambro System, a major structural component, has inferior concrete. Based on this fact alone, the Dayton’s should not be occupying the home because of health, safety and welfare concerns, and the home should be “Red Tagged”, until this matter is resolved, or proven untrue. http://www.ncbarch.org/hswdef.pdf

I’m sure the Dayton’s have a complete explanation of all these publically recorded document’s, and can fully justify why they have made so many people’s lives so miserable since selling their beautiful 872 sq. ft. 2 bedroom, 1 bath home in Ohio, valued at $61K, and now living in this horrible home that is even too dangerous to live in.

In responding to your asbove comment, I did not vote for the design being considered. I actually voted for the design that provided the most clearance for boats. Kind of a "self serving" vote. I, personally, do not care what type of replacement bridge gets built, just so long as the bridge is replaced.

Please do not be too sure that Realtor's have much of a fiduciary responsibility. If they do, it is limited. What a buyer or seller believes about Realtors may not be that accurate.

The Realtors are limited to what the seller tells them and possibly some research. Their verification of information is minimal. If the seller gives them incomplete or incorrect information on a listing, there is very little you can do to the Realtor and in many cases, very little you can do to the potential seller. This is even if you go to contract. Contracts are broken all of the time for some missed bit of information.

That is why you need a reputable title company or lawyer to VERIFY everything before you go to closing.

Fiduciary and Reputable are two words quickly forgotten when the word Greed supersedes them.

I have been following the attached Blog for years, and you will be amazed how many Professionals, who claim to be Reputable, place money first.

Your statement above is true, and is the reason Buyers and Sellers rely on Realtors licensed by the State, to protect their interests, because they believe the Realtors have a Fiduciary responsibility to do so, as defined below.

Unfortunately, in some cases, the need, and in others, the greed, win over the Rule every time.

Your analysis of this issue is correct, and ties to the earlier article by Commissioner Honig.

Until real numbers are published on the replacement vs. repairs, the entire matter remains mute.

I asked Commissioner Honig, in his last letter, to publish the cost per lineal foot of comparable existing bridges on our Island over the last few years.

Once “We the People” see the difference in the numbers compared to the five bridges under consideration, the choice become as simple as ABC.

I have no idea who authorized, and why, two million has been wasted on “Designs”, but that is who the person, or persons the bridge should be named after, and we can refer to it a Monument to Stupidity.

Any inch clearance more is an increase of the property value by a couple of $$$ 10 000.
13ft. is not enough for 30 ft. boats or bigger.
Space for average fly bridge boats or cruiser 40 to 60 ft. will be graet. That will improve Marco Island as boater community.

First of all, the lots in the section of Marco affected by the Smokehouse Bridge are not wide enough to accommodate large boats.

Second, the higher the bridge becomes, the longer it must be to meet slope requirements mandated by the ADA, and other government agencies.

It is the "Truth and Nothing but the Truth" about how this Once Great Country went down hill.

The falsely inflated real estate prices during the 2002 to 2008 period were, and still are, a major problem. The inflated prices reflected on the taxable values of all homes, and allowed our government to increase their budgets, which need to be re-adjusted back to reality.

From what I understand, the “the 12 million work of art proposed a few years ago” is still on the table, and will be built.

If this is true, and our new Council is powerless to do exactly what Mr. Honig is suggesting, and we blow 12 million, then the entire re-election process was a waste of time.

Regardless of the present condition of the Smokehouse Bridge, two approaches need to be studied: 1. Bids taken for repairs, and, 2. Replacement using a Standard Bridge Design, not a “Work of Art”.

Then the “Funding Part” can be planned based on real numbers, and not some dream project.

If some people want the “Artsy Crafty” look, maybe the new bridge can be painted to match the Art Building on Winterberry.

The Smokehouse Bridge appears to be a safety issue, or we have been told that it is. I do not believe that a referendum is needed when health and safety issues are involved.

The Mackle Park issue is a rather small interest group issue, does not appear to be health and safety related (unless, of course, council gets to spin it that way) and should be put up for referendum.

The Smokehouse Bridge is just another example of how our previous Council spent money without any concern for "We the People".

The Bridge was not declared unsafe, but is in need of repairs, but from what I understand the "Monument to Stupidity" will be built anyway at a cost three time as much as the Jolly Bridge, and shut down Collier Blvd. for who knows how long.

This is a mental health issue, not just a character flaw. Pathological narcissists are dangerous because they look normal and even intelligent. It is this disguise that makes them treacherous. Today the Democrats have placed all their hopes in Obama. But this man could put an end to their party. The great majority of blacks voted for Obama. Not surprisingly, Adolph Hitler also wrote his own autobiography when he was still a nobody. So did Stalin. For a narcissist no subject is as important as his own self. Why would he waste his precious time and genius writing about insignificant things when he can write about such an august being as himself?

Narcissists are often callous and even ruthless. As the norm, they lack conscience. This is evident from Obama's lack of interest in his own brother who lives on only one dollar per month. A man who lives in luxury, who takes a private jet to vacation in Hawaii, and who raised nearly half a billion dollars for his campaign (something unprecedented in history) has no interest in the plight of his own brother. Why?

If an issue raised in the Senate does not help Obama in one way or another, he has no interest in it. The "present" vote is a safe vote. No one can criticize him if things go wrong. Those issues are unworthy by their very nature because they are not about him.

Obama's election as the first black president of the Harvard Law Review led to a contract and advance to write a book about race relations. The University of Chicago Law School provided him a lot longer than expected and at the end it evolved into, guess what? His own autobiography! Instead of writing a scholarly paper focusing on race relations, for which he had been paid, Obama could not resist writing about his most sublime self. He entitled the book Dreams from My Father.

Actually Mr. 26, the "spawling" that has occured and is occuring is a severe structual problem.
The now "concerned" settlement of the bridge abutment on the north side with the possible placement of pilings is a severe structual problem, starting with the engineering design that was accepted by the "city" and built by a "not so good construction company" as quote by the Phoney PHD!

Like I said before, I did not see the scope of work, or inspect the problems, so I assume you are correct, and have a similar construction background to mine.

The Devil is always in the details, and if we have people doing inspections who are not familiar with them, we will continue to see issues with City projects as simple as new sidewalks.

I have not seen a scope of work for the project, and base my assumption on the above remarks by happyhorwitz34145.

For example, the “shoddy concrete work” is a result of the rebar not being coated, and set to high in the concrete. The concrete coverage over steel rebar is a minimum of 1.5 inches to prevent salt from coming in contact with the steel which causes the steel to rust and swell resulting in spawling.

This item, and the others mentioned are a result of “shoddy inspection”, and could have been prevented.

The repairs are due to the construction company that the city first hired to build the bridge.
Poor attempts of trying to bond hot top to concrete on the approach ramps, shoddy concrete work causing spawling to occur and expose rebar, concrete sidewalks settling or breakin apart, and erosion on the sides of the sidewalks due to poor planning and engineering.
All this at a cost to taxpayers at a cost of 100K plus.
The seawall at the base of the bridge is also being repaired due to poor work.
Also, Barfield Dr. in the original bid (according to the city website)was to never be closed to thru traffic dduring the repairs.

None of the problems you are sighting are “Structural”, but rather a result of poor inspection practices during the construction process, which I assume falls on the shoulders of someone working for the City.

The same non-structural problems exist with the Smokehouse Bay Bridge which “We the People” are about to spend over $11M to replace it.

Even if it cost ten times as much to repair the Smokehouse Bay Bridge that is being spent on the Barfield bridge, “We the People” will save $10M, and not be taking a detour for over one year.

Written on Naples man dies Saturday night in Golden Gate motorcycle-car crash:

Dimas Maldanado was not just a “Naples Man”, because he was a hard working “Marco Man” as well.

In fact, Dimas was on his way to work the midnight shift as a Bellman at the Marriott, where he has been employed for 20 years, or so, and leaves two children behind.

He will be missed by his family, hotel staff, and guests as well.

The driver responsible for this tragedy needs to be held accountable for his untimely death.

Now that we agree on something, can we also agree that President Reagan, who also helped Germany by tearing down the Berlin Wall, was the best Republican President during our time??

Also, how can you compare the actions and spending habits of HST to your unsung hero BHO, who spends more of our money on one vacation than HST spent in his entire lifetime???

As HST said, "The Buck Ends Here", but how did he know it would be named BHO who would do it??

The water is like everything else all of our Government agencies shove down our throats, and tell us it's for our own good.

About all anyone can do is filter, boil or drink bottled water, which, by the way, you have no clue what is in it either.

This is a story about the last great Democrat President we have had in our Once Great Country:

Most people won't believe this happened, but it DID. Harry & Bess (This seems unreal.) Harry Truman was a different kind of President. He probably made as many, or more important decisions regarding our nation's history as any of the other 42 Presidents preceding him. However, a measure of his greatness may rest on what he did after he left the White House.

The only asset he had when he died was the house he lived in, which was in Independence Missouri. His wife had inherited the house from her mother and father and other than their years in the White House, they lived their entire lives there.

When he retired from office in 1952 his income was a U.S. Army pension reported to have been $13,507.72 a year. Congress, noting that he was paying for his stamps and personally licking them, granted him an 'allowance' and, later, a retroactive pension of $25,000 per year.

After President Eisenhower was inaugurated, Harry and Bess drove home to Missouri by themselves. There was no Secret Service following them.

When offered corporate positions at large salaries, he declined, stating, "You don't want me. You want the office of the President, and that doesn't belong to me. It belongs to the American people and it's not for sale."

Even later, on May 6, 1971, when Congress was preparing to award him the Medal of Honor on his 87th birthday, he refused to accept it, writing, "I don't consider that I have done anything which should be the reason for any award, Congressional or otherwise."

As president he paid for all of his own travel expenses and food.

Modern politicians have found a new level of success in cashing in on the Presidency, resulting in untold wealth. Today, many in Congress also have found a way to become quite wealthy while enjoying the fruits of their offices. Political offices are now for sale.

Good old Harry Truman was correct when he observed, "My choices in life were either to be a piano player in a woman of allegedly ill repute house or a politician. And to tell the truth, there's hardly any difference!"
