It’s about time that someone from City Staff brought attention to the Laws of the ADA, or Americans Disabilities Act, standards. Thank you Mr. Pinter, I have personally tried many for years, I have even gone the as far too invite City Council Staff to spend a few hours Wheeling Around The Island In My World, in Wheelchairs I would provide at no cost, I’ve never had any takers! Mr. Pinter we’ve had numerous conversations during the Sewer Project & Repaving of Whiteheart Ct at 1063, specifically when it came to my Accessibility going in and out of my driveway in my Wheelchair, due to the fact that the New Asphalt was going to be approximately an inch or so higher. I applaud the fact that you were interested enough to personally see that this problem was not overlooked and taken care properly.

Mr. Pinter talks about looking into Standardizing & Widening the Islands Sidewalks and how it would bring the City into the 21st Century, meet ADA, or Americans with Disabilities Act, Standards, Sounds Great!!! I ask why bother wasting time or money when it will benefit absolutely No One who is covered under the ADA, or Americans with Disabilities Act, because as I’m sure you see ever day how a large majority of Islanders Continuously Break the Law by Parking Across the Sidewalk at the End of Driveways? After living here 20yrs I can tell you theses people are the same folks who think the Striped Area Next to the Handicap Parking Spaces is a Shopping Cart Return!!!

Therefore unless the City plans to Seriously Enforce the Parking Laws the project would no doubt be waste money. However if the City was to directed Police Chief Don Hunter to have his Officers Increase & Enforce the Parking Laws At All Times and Not Back Down like they did last time when confronted by some ignorant, inconsiderate, angry residents, the revenue from theses Parking Tickets could be designated to help fund such a Wonderful Project!!!

Would it be possible to include replacing the 2-Queen Palm Trees the City of Marco Cut Down for No Reason in our Whiteheart Ct Cul-de-sac Last Year in this project? The City blamed the cutting down of the Trees on LCEC. However after talking with LCEC they launched an investigation too find out exactly who Cut the Trees Down. Within a week I received a call from Randy at LCEC it was determined that it diffidently was the City of Marco who Cut the Trees Down!!! Because if they had Ordered the 2-Trees to Be Cut Down, their Detailed, Monthly Bill & Records from Asplundh Tree Expert Service would have shown Charges for Cutting them Down!!! After all I paid for the Cul-de-sac too is Cleaned Up & Professional Landscaped way before the Island was a City!!! Beside all this there is No-way the one Tree would have ever interfered with the Wires, because it was Off to the Side and Behind the Power Poll. There was only one time when this Cul-de-sac was not maintained weekly along with my property at 1063 Whiteheart Ct that was when Divco was building at 1064 and they destroyed everything in it by parking and driving through it daily. I never asked anybody for any reinvestment for having it project, so I can have the Cul-de-sac Professional Replanted Again? Maybe then Our Cul-de-sac could become a Winner during this years 2012’s Marco in Bloom!!! I promise the people of Whiteheart Ct that I will personally see that we have the most Exquisite Cul-de-sac on the Island by the Spring of 2012; however we will never accept an Awards unless the Beatification Committee or the City see’s that the 2-Queen Palm Trees the City Cut Down are Replaced ASAP!!!

Yes it certainly doesn’t take Rocket Scientists to figure out that it would be cheaper for the City to pay to have his prescriptions delivered. But just think how you would feel if you could not go safely to get your Beer or Liquor? The man is a Human Being and has the right too go where he want to go when ever he wants too according to the American with Disabilities ACT!!! This will be a tough decision because the City neglects to enforce many of the ADA Laws; they don’t even ticket the Cars That Park Over The Sidewalks. Theses Cars cause obstacles that make it impossible for people like myself to navigate the sidewalks in our Wheelchairs. Every night there are atleast 4-5 Vehicles blocking the Sidewalk on my street Whiteheart Ave down into Whiteheart Ct. Many don’t know that in Florida it is Illegal to Wake in the Street if the Street has a Sidewalk.

Title XXIII Motor Vehicles / Chapter 316 State Uniform Traffic Control 316.1945 Stopping, standing or parking is prohibited in specified places: On a sidewalk: On a crosswalk: In front of a public or private driveway.

It is the outlandish expenditures like this planed Retirement Party that keeps our City constantly looking for ways to cut its budget & figuring out how to increase resident’s living expenses!!!

I suggest that Officers be on duty around the location of the party when it ends and due DUI Checks. I am sure the City will be able to collect some serious cash, the cash collected from DUI Ticketing could help lift the cost residents paying for Feeding the Island Cow, the Cash Cow that the City keeps Milking!!!

We had our Cul-de-sac Professional Landscaped in 1993 with Native Planting that were Drought Tolerant then had to re-do-it after Divco Cons. destroyed it while building at 1064 a few yrs ago and what happened the other week the City of Marco Is. Told LCEC To Cut Down Our 2-Queen Palm Trees With No Notice & For No Reason At All Because They Were Not Touching Or Interfering With The Power – Lines At All !!!

When I called the City they blamed LCEC for cutting the Trees Down. However after calling LCEC I found out It Was the City of Marco Who Instructed LCEC To Cut the 2-Queen Palms Down!!! LCEC Had Nothing To Do With The Decision To Cut The Trees Down. Why The City Wanted Them Down Is Yet To Be Known. I'm dam sure if the City had planted the trees using Tax Payer Money they sure as hell would have removed them and planted them somewhere else. So why bother trying too making your Cul-de-sac Look Nice!!! If the City or the Beautification Committee Didn't Like Our Choice in Trees & Plantings That's Too Dam Bad. There are many things I don't like about them. What’s next is the City going to tell us What Color We Can Paint Our Homes? Theses 2-Queen Palm Trees along with the Cul-de-sac have been Professionally Maintained Weekly and Trimmed Several Times a Year or As Need Since 1993 and There Never Was a Problem until this year why?

I WANT MY TREES BACK ASAP OR I WANT TO BE PAID FOR THEM ASAP!!!

Mad as Hell I'm actually so dam mad I'm seriously considering moving off the Island. 1st I have had my ADA Rights Violated Because I am restricted from pushing my Wheelchair around the Marco Island Sidewalks due to the Arrogant, Ignorant, Inconsiderate, Uneducated and Inconsiderate Clowns who think Sidewalk Parking OK!!! Tickets were given out for a short time then stopped after people complained about them and now my 2-Beautiful Queen Palm Trees are Cut- Down for No Reason and when questioned my City blames someone else for Cutting the Trees Down. When it actually was the City who Directed LCEC to Cut-Down the Trees!!! LCEC only did what the City asked of them. What's next is the City going to tell us what Color to Paint Our Houses!!! I have nothing against our Police Chief that is leaving wish him good luck. Hopefully our next Police Chief will have the Balls to see that All Sidewalk Parking is Ticked Until It Is Eliminated Completely, it's not just my street it's everywhere. The ADA is the Law, it's not a joke as so many think.

I was told the Seafood Festival Shuttle Buses are Wheelchair Accessible is that correct? Is this event set up in the Grass Areas or in the Paved Areas? If in the Grass Areas, how is a Wheelchair User supposed to push around in the Grass? Think about it and don’t be so quick to answer, I also suggest that you try pushing a Wheelchair through the Grass Areas before responding. I can personally tell you from 25yrs of Wheelchair experience, when it comes to the combination of Wheelchairs and Grass it’s a NO!!!

I hope the Sea Food Festival Event Planners, Marco City Officials and Code Enforcement have already taken this matter into consideration or will after reading and receiving this note, I advise all to take this matter very seriously!
Due to the fact that under American With Disabilities Act Laws such a Public Event must be 100% Wheelchair Accessible or the Event will be in Direct Violation of all ADA Laws!!! Such a Violation could become very costly and embarrassing for the City of Marco Is.

There is a solution to this Wheelchair vs. Grass ADA problem. The Sea Food Festival provides personal assistance, for Wheelchair Users while maneuvering around through the Grassy Terrain, at all times during there stay at the Festival, in doing such this would the bring the Sea Food Festival into Complete Compliance of all ADA Law’s. Sitting back and doing nothing, to rectify this situation will open the door for the ADA too bring costly fines to our already cash strapped City and it’s Tax Payers!!!

Once again I say "Think about the Parks Name and what it stands for before you rush to judgment a make s----- response". Doesn’t the name VETERANS PARK say it all!!!

I recently sent this note below to City Council regarding Veteran's Park Events and the ADA Accessibility Laws that are ignored at every event. I'm sure you are well aware that the ADA Laws provide Equal Access to all Americans,
however all Veteran's Park Events thus far have failed to Comply with the ADA Laws!!! After reading this I hope people will understand how frustrating this situation can be and appreciate my trying to make the City and it's Residents aware of the need for a permanent solution to this Illegal Activity, before it escalates into Very Costly Lawsuit with the Government.

Will the Three Buses provided for On-Island Transportation be Wheelchair Accessible? If the Buses are not 100% Wheelchair Accessible, providing them without Access will be a direct violation of several ADA Laws.
I advise Festival Organizers to seriously look into this Accessible issue because the ADA doesn’t play games and there fines get very expenses. If not look out!!!

A Marco City Hall meeting on Friday resulted in the City’s decision to put up about half the Normal Holiday Banners and Christmas Island Style volunteers will put up others. Exactly what are the “others you refer to” that the Christmas Island Style volunteers will be putting up?

In reading about Friday’s meeting I read that the City will follow its legal advice and not use banners representing the Jewish holiday, nor ones that say “Merry Christmas.” If the City has decided to use the Attorney’s advice then why the hell is the City going to allow Mr. Christmas Clown to put up the banners reading “Christmas Island Style”?

This is really a kick in the pants to the Islands Jewish Community what’s wrong with including banners that read
“Hanukkah Island Style” Or just put up multi culture banners reading either “Seasons Greetings or Happy Holidays what about trying something totally different banners reading “Island Style Holidays or Holidays Island Style”

After all the meanings of Hanukkah and Christmas have absolutely nothing in common other than the fact they are both celebrated approximately around the same time of year.

In Hebrew, the word “Hanukkah” means “Dedication.” The name reminds us that this holiday commemorates the re-dedication of the holy Temple in Jerusalem following the Jewish victory over the Syrian-Greeks in 165 B.C.E.

Christmas is about the celebration of the birth of Jesus Christ. We don't know what day he was born on but it has traditionally been celebrated on the 25th of December. The modern English word Christmas comes from the Old English Christes Maesse (Christ Mass), the name of the service of Holy Communion that commemorates Christ's birth.

Getting the City Attorney involved in this matter was ridicules and I hope his advice came without a price tag, because it sure wasn’t very professional or ethical. I thought the City Council wanted to try and bring the community together again. I’m sorry with a decision like this you are definitely eliminating a part of the Islands population along with Culture.

Myself personally not being Jewish but having a Grandfather and his side of the family who are Jewish I think this is a disgrace. Is it possible that this decision has to due with the City’s lack of funds to purchase some New Hanukkah Banners? If’s that’s the case I’m dam sure the Jewish Community would help raise funds to purchase some Hanukkah Banners.

I will personally put up the 1st $500 for the purchase of them in memory of my Grandfather and my Heritage. I hope I haven’t bored you but this a matter of keeping our community together.

What does the City Council & City Attorney suggest the Jewish parents tell there children when the children ask why aren't there any
"Hanukkah Banners"?

There is no question about it Mandated School Uniforms for every child in every school in Collier County from Pre-K through 12th Grade will definitely help to transform a campus environment in a positive way too all schools. As far as having to conduct a survey of parent’s staff members and students before a School Uniform Policy can be approved, is absolutely ridiculous. School is not a Fashion Show, School is a Learning Center where we send children to be Educated! A Uniform Policy must be a Two Way Street for both Students and Teachers alike, because as your children get into the upper grades the Teachers blend right in with the Students making it near impossible to tell then apart. Students’ Navy or Kaki Bottoms, a Variety of Different Colored Tops possibly certain Colors for each grade. Teachers a more professional style, for the Male Teachers Neatly Pressed Slacks & Dress Shirts with Ties and Causal or Dress Shoes No Sneakers, Female Teachers Neatly Pressed Dresses or Skirts with a Blouse and Causal or Dress Shoes No Sneakers. Let’s not forget the Principals and there staff, Male Neatly Pressed Suits or Sport Coats with Dress Slacks, Ties and Dress Shoes, Female Neatly Pressed Dresses or Skirts with Blouses and Dress Shoes. It’s not the 50’s or 60’s all the Schools are Air Conditioned so don’t complain, remember your supposed to be a Professional.

The question with this case is his Eligibility to Qualify for the Tax-Free Exemption? Because you can not be in a Hospital in Cleveland Ohio for a year and still Qualify for the Tax-Free Exemption at the same time, when the Collier County Tax Law States “Collier County must be your Primary Residence for more than 6 Months a Year to Qualify for the Tax-Free Exemption.” It is very obvious the people saying Mr. Skinner will look like a Hero if goes to bat for this guy and Reinstates Jeffery Friedman Tax-Free Exemption to include his 2008 Tax Bill, are both Ignorant and Uneducated regarding this Law. Because of my status and eligibility I also receive this Tax-Free Exemption. Therefore my knowledge on this subject is very extensive. If anyone cares to dispute me please do I have all the facts.

When I originally read about the Seafood Festival I thought how nice, what a great place to take my out of town guest for the day, especially because of the Transportation Shuttles that were going to run continuously around the Island. The Shuttles may have run continuously and had numerous pickup locations around the Island during the day. However the Shuttles the event organizers provided lacked one very important thing to my guests and I THEY WERE NOT WHEELCHAIR ACCESSIBLE AT ALL AND THAT IS AGAINST THE LAW!!!

Let this be a word of advice to the individual or individuals that organized the Shuttle Service for the Seafood Festival and others thinking of providing similar Shuttle Services in the future for other Island Events, although it is a nice gesture due to the limited number of parking spaces, it’s against the Law to provide transportation to the public without including vehicles that can accommodate Wheelchairs. If you haven’t noticed the entire fleet of the CAT Transportation Vehicles can accommodated Wheelchairs reason being they are providing a Transportation Service to the Public and it’s the Law!!!

Therefore if organizers of Island Events continue providing Public Shuttle Transportation Services without providing Wheelchair Accessible Transportation Vehicles during events I WILL HAVE NO CHOICE BUT TO FILE A COMPLAINT WITH THE ADA!!!

Free Access and Freebies for all are over, Dogs included. Maybe now the City will have enough money to make the Islands Puppy Palace meet ADA Codes! How nice it would be for Islanders with Service Dogs to have a place to let there Dogs Run also. After all accessibility is the Law under the Americans with Disability Act!

The non-accessible issue at the Dog Park is like this, the City has two choices, they can pay now and make the Dog Park Wheelchair Accessible, or they can choose to do nothing as they have done so far. Let this be an alert to Dog Park Users and Taxpayers if the City continues to due nothing in regard to making this Dog Park Wheelchair Accessible and waits until the ADA gets involved not only will the cost of making the Dog Park Accessible increase the City will be subject to Daily Fines, the fines will be retroactive from the date of this parks grand opening. Think about it, if this happens an annual fee at the Dog Park could be very costly. It doesn’t matter if the Dog Park was donated or not the fact that it is not Wheelchair Accessible is against the Law according to the American with Disability Act known as the ADA!

This has nothing to due with the Dog Park, however it has to do with 2 Dogs and the 2 pigs who I witnessed walking there dogs along Elkcam in front of A-Tech Automotive on 3/16 they let there 2 dogs Poop on A-Tech’s property and never even attempt to pick it up as A-Tech and I watched. How low class and disgusting you people are, you are a disgrace to the majority dog owners. You might as well let your 2 dog’s just poop in his car wash bays at least he could wash it down.

If uneven surfaces prevent advanced life saving techniques and interfere with transporting a stretcher across them, then the Island has a very serious problem. Because during the STRP the Islands Streets involved were resurfaced 1" Higher than driveway aprons unless the aprons were damaged and replaced during construction at which time the driveway aprons were raised up 1" to accommodated the newly paved streets. Also what about when Cars are Parked Across the Sidewalks the Stretcher ride across the grass swales is a little bit rough also.

Trust me from personal experiences the Marco Islands Firemen, Paramedics, EMT’S and Ambulance Staff are some the most impeccably trained, qualified and experienced emergency workers in the country. Believe me they will transport you or your loved ones, safely in the most professional manner as possibly from point A to B just leave the Transporting and Driving Decisions Up To Them. Just Be Happy and Enjoy the Ride.

Let this be a little word of advice to the wise if an Establishment of any Kind, Way, Shape or Form Increases the number of the Parking Spaces they provide, they must also then Increase the number of Handicap Parking Spaces the have, According to the American Disabilities Act Laws. Also remember the Law requires that Handicap Parking Spaces be the Closets Parking Spaces to the Entrance, not a Parking Lot Away!

I personally have never met Dr.Guidry nor do I know anything about him pro or con.

However I have a very serious question if the Judge ordered Dr. Guidry to undergo a Psychological Evaluation. Why the hell the State Medical Board didn’t immediately suspend his Lincenses to Practice Medicine, atleast until such Evaluation has been completed and the State Medical Board has received both the results and recommendations of the Psychological Evaluation? Doc believe me I’m not trying to give you a hard time and take monies out of your pocket during theses tough economic times, but if you think about where I’m coming from I think you’ll agree.

Those who disagree with me think about this, if a Judge ordered the Doc of your wife and daughters who pledged guilty, to have a Psychological Evaluation would still you want him or her to practice medicine on them one of them?

It makes know difference if size matters or not on this Island when it comes to Politically Signs. Theses wanna be Politicians start before they even get Elected to try and take over our Island, just look the way they scatter and litter our Island with all there Election Signs. There signs increase in size and number every year. Politically Signs on Marco are no longer just an eyesore they are now causing Marco Island to look very cheep and cheesy. How dare a non Politician increase the size or number of Property Sale Signs, or put up one extra Yard Sale Sign without being fined. Marco Island is maybe one Election Year away, from having Election Signs placed strategically in all directions that will lead you right to your preferred Politicians Front Door. Theses New Election Signs will be as annoying, colorful, funny and distasteful looking as those South of the Boarder Ahead Signs one incurs while traveling along Interstate 95, miles and miles before you even come close to arriving at the Boarder. For a complete preview of the New Election Signage to come, you don’t have to travel to Interstate 95. Just drive by the New Museum and check out all the Construction Signs picture your favorite Politicians Names and Pictures plastered on Signs like them all over the Island, before next Election. What a site I’m sure you’ll agree!

It won’t be to long before the Dog Park starts taking a Bit out of the City’s Budget and Taxpayers Wallets. Due to the fact that the Dog Park Developers neglected to make sure the Dog Park was built to be in compliance with the ADA Codes! Therefore people with Licensed Service Dogs particularly the Blind and Wheelchair users some of whom are Veterans will be excluded from being able to participate and have fun with there Dogs at the Park. When I questioned the Parks Director he said they didn’t have enough money to make it Accessible. Well if the City would strictly enforce the Parking Over the Sidewalk Laws 24hrs 7days a week and not just occasionally, there would surely be enough money collected to Help Fund small Island Projects like this one as needed. It is very obvious that the Marco Dog Park did not receive an inspection by a licensed inspector that was knowledgeable of the ADA Codes or the Dog Park never would have been permitted to open in the first place. I’m starting to feel like maybe Marco Island would prefer that Americans with Disabilities didn’t even live on the Island. Guess what I’m here to stay and so are the ADA Code Compliance Fines!

With Vendors Fees set at $650 for a Entire Season or $150 monthly and 98 Vendors are the Fees paid directly to the City of Marco Is?

If theses Vendors Fees are paid to the City, what are they used for?

Fortl you mentioned the Government, I’m not sure if you are referring to the entire $30 Million Project or just the Landscaping part of it? It is extremely irresponsible for any Government Agency to even think of doing such a Landscaping Project during theses Tough Economic Times! Never the less do it in an area where a new Bridge is going to be constructed in the near future. Wait and see after the Bridge Construction it will need to be done all over. Hell during the Sewer project in front of my home they didn’t even dig around the circle and still managed to kill and destroy most of the planting in circle. Spending this $30 million the Government is slapping us Taxpayers in the face, again, the same way General Motors and Chrysler Executives slapped Taxpayers early this year when they Flew there Corporate Gulfstream Jets to Washington and asked for the Billion’s of our Taxpayers Dollars, that our Government was s----- enough to give them. Perfect timing as usual hurry up and gets the Island Spruced Up before all the Snowbirds Arrive Back. It’s the same thing every year the Government sets the Island up like a Dog & Pony Show, so the Snowbirds have something New to Gawk at, for all the Tax Monies they paid while away. Then once the Winter Dog & Pony is over all the Full Time Residents have to pick up the Crap. It’s all a game and year after year in the end the score is always the same Snowbirds 7 Months and Full Time Residents 5 Months.

JoeFubietez I certainly understand your views and perspectives on my letter and I agree with what I think is your frustration. However if we don't start too Stand Up and Fight for Our Rights we might as well move to North Korea or Cuba.
I personally know what it is to Fight a Battle and Win. I fought for my Life 23yrs ago against all odds and Won! It was an Injury from a screw up that I Battled, it required a combine stay of 372 in the Hospital and Rehab but I did it and I’m still here. Therefore let it be known as of 11/26/2009 this Wheelchair User is ready to Battle Once Again, after winning the Battle for my Life this Sidewalk Parking Battle will be simply a Walk in the Park. Trust me the ADA doesn’t play games you will see!

Rob: You should pat yourself on the back, Job Well Done! You did what know others Islanders were able to accomplish you finally brought some Youth to our City Council for the first time. In doing so, I hope other Younger Island Residents will step up and run for City Council in the very near future. God knows it’s about time we move on with a Younger Perspective and Direction for our Islands future. It’s time our Marco Island elderly residents that were former CEO’s, Executives, Business Owners, Businessmen, Numbers Crunchers, etc. From the 40’s 50’s and 60’s finally put there Adding Machines Away and Stop Running for City Council. If they still feel the need to be in Politics, they could become Mentors for the new Younger Councilor’s our City desperately needs. Our City whose population is getting younger every year would greatly benefit from there mentoring, after all someone helped them along and gave them a start.

Mr.Kiester I would like to know exactly what you definition of Backed Off is and why the Police have Backed Off? Did City Council tell them to Back Off? Mr.Kiester I’m not sure what Cloud you drive around on but driving around on this Island, both Day and Night it doesn’t even look like the Police ever started issuing Parking Citations. During there routine drive by every night on my street the Police never even stop too issue Parking Citations and YES Every Night There Are Vehicles Parked Illegally As Well As Many Days! If the City allows a Back Off on this Parking Issue, what’s next will Smoking be allowed during City Council Meetings? Mr.Kiester this is your opportunity to step up to the plate and make a difference, not just slap the Americans with Disabilities in the face again. I think it's about time the some members of the City Council take a good look in the mirror your not getting any younger therefore the day will come when you might not be able to walk around the Illegally Parked Vehicles on our Island.

Florida Laws for Pedestrians and Drivers: [§316.130(3)].
Pedestrian Traveling Along a Street or Highway Where sidewalks are provided,

The ADA ACT was created to Protect the Millions of Americans with Disabilities from situations exactly like this Island Sidewalk Parking Issue. The ADA Act has Drastically Changed and Improved the Quality of Life for Millions of Americans with Disabilities, giving us back our Freedom, Independence, Pride, Dignity and the Feeling of Self-Worth Again. Most likely one of your own family members or friends has benefited from the ADA Act as well?

Islanders unless you are prepared to Open Up Your Wallets and help the City of Marco Island Pay for the Exuberant Legal Costs the City will incur if the ADA gets involved in this Sidewalk Parking Matter, I suggest you all Learn How Park Properly!

I hope everyone knows the New Dog Park Is Not going to be Wheelchair Accessible. Didn’t anyone hear of The US Department of Justice Americans with Disabilities Act (Referred to as the ADA)? What a disgrace this will be, for the Americans with Disabilities who have Service Dogs. I was told they didn’t have enough money to make it Accessible. I have a question, if the City doesn’t have enough money to make the Dog Park incompliance with the ADA Codes, where are they going to get the money to pay the ADA Fines when they start receiving them?
